Conscious Whānau Dynamics — April Broomhead

1. Overview
This website and its offerings are owned and operated by April Broomhead, trading as Conscious Whānau Dynamics (referred to as “we”, “our”, or “us”). By accessing our website, purchasing services or products, or participating in our offerings, you agree to be bound by these Terms and Conditions and our Privacy Policy.
If you do not accept these terms, you must not access or use this website or our services.
We reserve the right to amend these terms at any time. Updates will be posted on this page, and continued use of the website constitutes your acceptance of any changes.
2. Services
We provide coaching, family therapy, educational programs, workshops, and products related to emotional intelligence and wellbeing. These services are not medical, legal, or financial advice and do not replace professional care from qualified practitioners.
3. Payment Terms

Payment is required in full (or by deposit if offered) to secure your booking or purchase.

Early bird discounts apply only during the promotional period and may be withdrawn at any time.

Course fees must be paid in full at least 10 business days prior to commencement unless on a payment plan.

Product orders must be paid in full prior to dispatch.

Deposits are non-refundable.
4. Cancellation & Refund Policy

Fees are non-refundable, except as required by New Zealand Consumer Law.

All refund requests must be submitted in writing via email.

If a course or service is cancelled by us, you may choose a credit, refund, or transfer to a future offering.

We may reimburse reasonable non-refundable participant expenses (receipts required), but we recommend travel and event insurance.

Notice of cancellation will be given at least five (5) working days in advance, where possible.
5. Intellectual Property
All content provided by Conscious Whānau Dynamics — including but not limited to program materials, website content, audio, video, and written materials — remains our exclusive intellectual property. This content may not be copied, reproduced, distributed, or shared without our explicit, written permission.
6. Confidentiality

All information shared by participants during sessions or courses is treated as confidential and must not be shared without written consent.

Sessions may be recorded for your personal use only and must not be distributed.

Coaching sessions are confidential but not subject to legal privilege (as in law or medicine).

We may use your name and contact details for credentialing purposes only, with discretion.

Confidentiality excludes information that is public, obtained lawfully by third parties, independently developed, or required by law to be disclosed.
7. Behaviour & Conduct
We reserve the right to remove participants whose behaviour is disruptive, disrespectful, or harmful. In such cases, no refunds or reimbursements will be given. Mutual respect and presence are expected in all interactions.
8. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including natural disasters, government mandates, or technical outages. In such cases, sessions may be rescheduled, postponed, or moved online. Refunds are not provided for client-side COVID isolation, but rescheduling will be offered where possible.
9. Legal Disclaimer

All content is provided in good faith for educational purposes and is not intended to diagnose, treat, or prevent any medical or psychological condition.

You are responsible for seeking appropriate advice from qualified professionals such as doctors, lawyers, or financial advisors.

We are not liable for the content of linked websites or third-party services.

Reliance on any information from us is at your own discretion and risk.
10. Client Responsibility

You are responsible for booking your own sessions (if not pre-scheduled). Failure to do so may result in forfeiture.

Come to each session prepared, grounded, and present. Bring a pen, water, and any tools that support your regulation.

Journaling breakthroughs, insights, and challenges between sessions is strongly encouraged.

Missed sessions, incomplete assignments, or disengagement are not valid reasons for refunds or reschedules.
11. Group Coaching
Participation in group coaching requires confidentiality, respect, and full presence. External sharing of group material or recordings without permission is strictly prohibited.
12. Emergency & Power Coaching
Power coaching sessions and emergency support are offered at our discretion and subject to availability. Please inquire if urgent support is needed.
13. Products

NZ delivery only for moon products. Books may be shipped internationally.

Delivery timelines are outlined per product.

Out-of-stock products will be refunded.

We do not offer change-of-mind refunds. Faulty items may be returned for replacement or refund.

While all efforts are made to package items safely, we are not responsible for damage during transit.

Prices and availability are subject to change without notice.
14. Digital Content & Recordings

Digital session recordings are available for 7 days. It is your responsibility to download them in that timeframe.

You may share recordings only with other participants, with proper credit where due.
15. Limitation of Liability
To the fullest extent permitted by law, we exclude all liability for loss, damage, or injury incurred directly or indirectly from the use of our website, services, or products.
16. Jurisdiction
These Terms are governed by the laws of New Zealand. Any disputes arising will be handled within the New Zealand legal system.
